4. General Terms of the Contract of Sale
Object of the Contract
These general terms and conditions govern the distance purchase of products via electronic networks on the website www.ducatihome.it. Consumer purchases are regulated by the provisions of the Italian Consumer Code (Legislative Decree 206/2005) and its subsequent updates.
These general conditions may be updated, supplemented, or modified by the website owner at any time without prior notice. Any changes will become immediately valid upon their publication date on the website.
Acceptance of the Conditions of Sale
The premises listed above constitute an integral and essential part of this contract. The sales contract is considered concluded when the final consumer or professional client ("Customer") completes the guided purchase procedure on the website. By confirming the order, the Customer fully accepts the terms and conditions outlined on the site and authorizes ducatihome.it to charge the total indicated amount, which includes the price of the products and the corresponding shipping fees. Each purchase is assigned a progressive, unique order number generated automatically by the system.
Product Availability and Substitution / Upgrade Criteria
Ducatihome.it accepts orders within the limits of existing warehouse stock. Therefore, acceptance of any purchase proposal is subject to the actual availability of the products. In the event of an unforeseen stock shortage due to an excess of demand or other causes, ducatihome.it agrees to promptly notify the Customer.
To ensure the fastest delivery times and maintain continuous service for the client, if the ordered product is out of stock or temporarily unavailable, ducatihome.it reserves the following rights:
  1. Equivalent Item Supply: To supply an alternative item featuring identical functionalities, compatibility, and technical specifications (e.g., supplying a different remote control model that retains full compatibility and the exact same functions).
  2. Complimentary Product Upgrade: To supply an alternative product of a higher level regarding technical characteristics and specifications, applying a completely free-of-charge upgrade to the buyer so they can carry out their automation or replacement works without delay. The Customer retains the right to cancel the order and request a full refund if they strictly prefer to wait for the original item.

5. Prices, Value Added Tax (VAT), and Customs Duties
Depending on the destination country, local regulations, and the specific market store settings, VAT and customs duties will be applied as follows:
European Union (EU) Customers
  • Tax Calculation: Depending on your country and browsing location, product prices may be displayed as tax-inclusive, or the correct VAT rate of your destination country will be automatically calculated and added to your total at checkout.
  • Business EU VAT-Registered Customers (B2B): If you are purchasing on behalf of a company registered within the EU (outside of Italy) with a valid VAT number, you can claim a VAT exemption. Please register a Company Account and enter your business data along with your EU VAT number. Once logged into your professional account, your shopping cart will apply the VAT exemption according to intra-EU rules.
Non-EU Customers (International Exports - e.g., UK, USA)
  • Local Taxes & Duties: If you are purchasing from outside the European Union, no Italian or EU VAT will be charged. However, import duties and local taxes may apply upon arrival and are the sole responsibility of the customer.
  • Customs Processing: The shipping carrier will process the import clearance at your destination country's customs and will inform you directly of the exact duty and tax amount you need to pay.
  • Regulations & Variables: Import regulations and charges are set by your local customs authority and depend on the type of goods, origin, and total value. The seller cannot provide an exact estimate of these costs as they vary frequently.
  • Important Warning on Refusing Delivery: If you refuse to pay the customs duties, the carrier may return the product to us. In this scenario, you will be charged for the two-way shipping costs (original shipping + return shipping) along with any extra administrative fees incurred. If a reimbursement is requested, this total amount will be strictly deducted from your refund. We highly recommend checking expected import fees with your local customs office before placing an order.

6. Shipping Rates, Tracking, and Self-Collection (Ex Works)
  • Shipping Not Included: Product prices displayed on the website do not include shipping fees.
  • Based on Carrier Rates: Shipping costs are calculated based on the official rates applied by our shipping carriers, which depend on your delivery address, as well as the total weight and volume of your order.
  • Mandatory Tracked Shipping: Although shipping fees with major carriers can be expensive, especially for certain remote or international destinations, the seller will not ship orders using alternative, untracked methods under any circumstances, even upon express customer request. There are no alternative or lower-cost shipping options available beyond those displayed.
  • Shown Before Payment: The exact shipping cost will be clearly displayed in your order summary before you proceed to the final payment stage.
  • Ex Works Option (Self-Collection): Alternatively, customers may opt for an Ex Works delivery (Franco Fabbrica) by selecting the dedicated collection option at checkout. In this case, no shipping fees will be charged by the seller, and the customer is responsible for organizing the package pickup. Collection can be done personally, via an authorized representative, or through a customer-appointed shipping carrier directly at the manufacturer's operational headquarters: via Cabriolo 50A, 43036 Fidenza (Parma), Italy.

7. Product Delivery and Mandatory "Cargo Damage Reserve"
All orders are shipped using qualified express couriers. To protect your rights if the package is damaged during transit, the following mandatory procedure applies:
  • Verification upon Receipt: When receiving the parcel, the Customer is strictly required to verify that the number of boxes matches the shipping documents and that the packaging is entirely intact, not crushed, punctured, torn, wet, or altered.
  • Mandatory Damage Claim (Filing a Reserve): In the presence of any slight sign of wear, tear, indentation, or alteration to the box or the sealing tape, the Customer must sign the courier's delivery receipt explicitly stating: "ACCEPTED UNDER RESERVE - DAMAGED PACKAGING" (detailing the specific defect, e.g., crushed box, torn tape).
  • Unconditional Signature Consequence: If the Customer accepts the goods and signs the delivery slip without adding any written reservation, the product is legally considered delivered in perfect condition. Consequently, ducatihome.it cannot accept any transport damage claims, nor process any refunds or replacements for issues related to shipping.

8. Installation Responsibility and Operational Safety
  • Assembly and Technical Requirements: The mechanical and electronic automation components sold on ducatihome.it require proper installation. All assembly must be executed in full compliance with the official instruction manuals attached to the product or downloadable from the support pages on the website.
  • Exclusion of Liability: Ducatihome.it declines any and all liability for material damages, financial losses, or injuries to persons, property, or animals resulting from incorrect mounting, lack of skill, technical tampering, arbitrary modifications to the components, or a failure to comply with local and European safety regulations governing automated gate/door systems (including EN 12453 norms).

9. Customer Support and Troubleshooting Policy
Any product purchased that you don't love may be exchanged or returned for a refund. If you received a damaged, defective, or wrong item, or need to modify or cancel a recently placed order, please contact our support department right away to resolve the issue easily and quickly:
  • Email: info@ducatihome.it
  • Telephone: 0039-0524-527967
  • Office Hours: Monday to Friday, 8:30 AM - 12:30 PM / 1:30 PM - 5:30 PM (CET).
To file a claim for a replacement or a refund, simply send an email to Customer Service stating the problem encountered. Providing a brief explanation helps our technical staff verify whether a replacement or an alternative technical solution is available.

10. Return & Refund Guidelines
Return and cancellation rights vary depending on whether the customer is a private consumer or a business profile, as well as their geographic region:
A. RETURNS & REFUNDS FOR EUROPEAN UNION (EU) CUSTOMERS
(In compliance with the Italian Consumer Code, Legislative Decree 206/2005)
EU Area B2C (Business to Consumers - Private Buyers)
The consumer's right of withdrawal is enshrined in Article 64 of the Consumer Code, which provides that a consumer (a natural person who privately makes a distance purchase for purposes unrelated to their business activity) has the right to withdraw from the purchase without specifying the reason and without incurring any penalty within 14 days of receiving the product (Legislative Decree 21/2014, implementing EU Directive 2011/83/EU).
  1. Notification: The consumer must notify the seller via email of their intention to return the product within 14 days of receiving the order.
  2. Return Shipping: The product must be returned intact and unused, complete in its original packaging, within 14 days of notifying the seller.
  3. Costs: The buyer is responsible for the shipping costs for returning the product.
  4. Reimbursement: The order will be refunded within 14 days of receiving the product back in perfect condition. The refund includes the price paid for the item and the standard shipping costs paid by the consumer during the initial checkout. Any additional indirect costs incurred for the purchase, product inspection, or return freight remain the sole responsibility of the consumer.
  5. Condition of the Goods: The product must be returned entirely intact, never installed, and free from any signs of wear, scratches, or mounting attempts. The item must be shipped back in its original packaging, complete with all components, accessories, hardware pouches, uncut wires, and user manuals. In the event that the product is returned incomplete, used, or damaged, the seller may decide to grant a partial refund only, deducting the lost value of the asset.
  6. Strict Exclusion for Customized Items: Refunds are not available, or are subject to the seller's specific assessment of each case, for sales of products for which the consumer has requested customization, such as a version of a product with customized software, custom-cut components, or a product painted in a custom color requested by the consumer.
EU Area B2B (Business to Business - Professional Sales)
The right of withdrawal and refund applies only to purchases made in a B2C transaction (private consumers). The right of withdrawal with return for refund does not apply to sales made B2B, i.e., to professionals, contractors, or companies who purchase in the exercise of their profession by providing their VAT number and requesting a commercial invoice. The Consumer Code does not apply to B2B transactions.
B. RETURNS & REFUNDS FOR EXTRA-EU CUSTOMERS (INTERNATIONAL)
  • If you are a customer who has ordered a product from outside the EU countries and you wish to return a product to get a refund, you must notify the seller via email to info@ducatihome.it within 14 days of receiving the order.
  • The product must be returned intact and unused, complete in its original packaging, within 14 days of notifying the seller.
  • The shipping costs to return the product to the seller are at the charge of the buyer, and the shipping cost paid in the original order will not be reimbursed. Any customs duties for the return entry are also the responsibility of the client.
  • The order will be refunded within 14 days of receiving the goods at our facility. The refund includes exclusively the price paid for the product, excluding original shipping and return shipping costs. Any additional indirect costs will not be refunded.
  • In the event of an incomplete, used, or damaged product being returned, the seller reserves the right to grant a partial refund only. Customized or personalized products are entirely excluded from refunds.

11. Limited Manufacturer's Warranty
11.1 Scope of Warranty and Duration
The warranty applies exclusively to defects attributable to manufacturing faults or structural material defects of the product itself.
  • B2C Warranty (Private Consumers): The warranty is valid for two (2) years, starting from the date of purchase (invoice date) or the proven delivery date, selecting whichever date is more favorable to the customer.
  • B2B Warranty (Professional Customers / VAT Holders): Purchases billed to a professional customer with a business VAT number are covered by a 12-month warranty period.
11.2 Warranty Claim Procedure
Should a manufacturing defect occur within the limited warranty period, the customer must immediately report it to the manufacturer’s after-sales service by sending an email to help@ducatihome.it or info@ducatihome.it.
  • Assistance Request Form: Before shipping the product back for inspection, a formal request for assistance under warranty must be submitted according to the specific service procedures described in our dedicated customer support section. Customers must fill out and place the official technical form inside the package, alongside a copy of the purchase invoice.
  • Freight Rules for B2C (Within the EU): Shipping costs for returning the product will initially be charged to the customer until the warranty is confirmed by the manufacturer following the technical inspection. If the defect is covered by the warranty, the manufacturer will repair or replace the item and reimburse the shipping costs incurred by the customer to send the product to the service center. The customer must keep a copy of the receipt proving the shipping costs incurred to request this reimbursement. The manufacturer will also cover the return shipping costs to send the item back to the customer.
  • Freight Rules for B2B and Extra-EU: For all sales made to business profiles (B2B) or buyers outside the European Union, all shipping and transport costs for the defective product shall be borne entirely by the buyer and are not eligible for any reimbursement.
  • Transport Risks: The product must be shipped adequately packed to prevent potential damage during transit. Any damage caused to the item during transport or shipping cannot be charged or attributed to the manufacturer. The product will be evaluated strictly in the exact condition in which it is delivered to our premises.
11.3 Exclusions and Limitations of Coverage
The manufacturer's obligation is limited strictly to the repair or replacement of the product at its own discretion. It is not possible to obtain a refund of the purchase price or contract termination without a specific written agreement with the management.
This limited warranty does not cover:
  1. Direct or indirect costs for the installation, inspection, disassembly, reassembly, or testing of the product performed by third-party installers.
  2. Labor costs, travel expenses for off-site technicians, or inconveniences and indirect damages caused by the inability to use the automated system.
  3. Parts or components subject to normal wear and tear and decay over time, such as fuses, batteries, battery packs, motor carbon brushes, light bulbs, etc.
  4. Damage caused by force majeure, natural phenomena, or extraordinary events, such as: fires, flooding, liquid infiltration, storms, hurricanes, tornadoes, lightning, electrostatic discharges, wind gusts, or insects/animals.
  5. Damage caused by careless, improper, or abusive use of the product, or by poor/inadequate maintenance of the gate or door structures.
  6. Problems or damages caused by electromagnetic interference or radio interference present in the airwaves caused by other external devices, incorrect electrical connections, or voltage fluctuations on the power grid.
11.4 Warranty Voidance
The product warranty is instantly voided in the event of:
  • Tampering, alterations, or modifications carried out on the product or its electronic/mechanical components by the customer or unauthorized third parties.
  • Installations that do not comply with state-of-the-art standards of the application field or fail to match the regulations listed in the instruction manual.
  • Mounting on structures presenting structural or safety defects, improper balancing, or poor maintenance.
  • Operating the system outside the weight, technical compatibility, and functionality limits indicated by the manufacturer.
If the fault does not qualify as a lack of conformity covered by the warranty, any technical inspection, restoration, and return transport costs quoted by the assistance center will be charged entirely to the customer.

12. Applicable Law, Dispute Resolution, and Jurisdiction
This contract is governed in every aspect by Italian law.
Online Dispute Resolution (ODR)
In accordance with Article 14 of EU Regulation No. 524/2013, consumers residing within the European Union are hereby informed that the European Commission has established an online platform for alternative dispute resolution (ODR - Online Dispute Resolution). This platform is designed to facilitate the out-of-court resolution of contractual disputes arising from online sales agreements. Consumers can access this official digital portal by connecting to the European Commission's ODR platform.
Competent Jurisdiction
  • B2C Consumers (Private EU Customers): For any civil dispute arising from the interpretation, validity, or execution of these conditions between this site and a private consumer, the mandatory territorial jurisdiction belongs to the court of the place of residence or domicile of the consumer, if located within the territory of the Italian State.
  • B2B and Non-EU Clients (Professionals & International Sales): For all commercial transactions carried out by companies, installers, professional VAT holders, or clients residing outside the European Union, it is expressly agreed that for any legal controversy, the exclusive place of jurisdiction shall be the Court of Parma (Italy).
